Terms and Conditions for Furniture

1;Estimate:

The "estimate" is the basis of the contract formed between the customer or business and Simply Wood (East) Ltd.  “Estimate,” the meaning of estimate in all cases mean's an "approximation", an estimated cost of the goods to be supplied at the initial time, date of the estimate. In no uncertain terms is the “estimate” deemed a "quotation". The “estimate” will always be based on the layout, of the kitchen, bedroom, etc or product and will be itemized accordingly to the drawings provided or product ordered. You, customer or business, will only be charged for what you have purchased, each product clearly defined in all cases, on your design and correspondingly your estimate. Your invoice will be subject to the final “order” based on the product you have received and agreed, kitchen, bedroom, etc, or product. If nothing has changed from the beginning of our “contract” based on the “estimate” in any way, the price of the items, overall price will not have changed. If the contents of the kitchen, bedroom, etc, or product "have" changed then so will the “estimate” and in all cases the changes will be clearly defined, with the "exception" of appliances, the price given is only valid from the date of the estimate for 7 working days unless secured with a 25% deposit or paid for in full, you as the customer or business will be aware in all cases of any changes that you as the customer or business have asked for. Any changes that Simply Wood would make, i.e structural changes to units etc, "no" cost would be incurred by the customer or business in most cases. Changes that incur a charge to the “estimate” can be; changes to door style’s, finishes, change of unit configuration, a cupboard to a drawer pack or an item of storage for instance, handles, worktops, appliances, painting costs, also see "exception" etc. Indeed the “estimate” can also be less than the original “estimate” and it will be clearly shown in the final order issued with our invoice. Previous estimates will be available for comparison, on request, although you should have already received these. In all cases it is advisable to check your estimate and contact us if you have any queries or are unsure of anything listed on your estimate. If Simply Wood was to have unintentionally omitted an item of consequence, then we would invoice you separately for the item, with our apologies.

Estimates are valid for 14 days from the date of issue, unless otherwise agreed in writing.

Provision of drawings, plan's, estimates

We offer a planning service and an initial consultation free of charge for one set of plans, without dimensions and an estimate based on this plan, there after if they are amended they are chargeable at £199 plus VAT but would be available with dimensions. If after supplying you with plans etc with any kind of measurements, for the installation of utilities etc, again this is chargeable at £199.00 + VAT. If the kitchen, bedroom, bathroom or other is to be purchased from Simply Wood, then no fee is charged for any amount of plans or estimates. 

All plans, estimates are the copyright of Simply Wood (East) Ltd until they have been paid for in full, either supplied as design only or with supply only, supply & fitting.

2;Payment:

The invoice will be dated from the date of issue of goods, or supply only or the start of an installation of the products/order

All payments must be paid in accordance to the sum of the “invoice only”

No sum of monies for “what-so-ever shall be omitted from the invoice”

Any discrepancies of the “invoice” to be confirmed in writing within 3 working days of issue, and if in the case of discrepancies occurring and re-issue of the invoice, amended, it shall still be payable within the specified date of issue of the original invoice

The term “trade” in all cases refer’s to business to business only

Trade payments Only; Payment is due 28 days from the date the kitchen, bedroom, bathroom, furniture, components are supplied, delivered to the business or site address, taken possession of, NOT the date the invoice is SENT to you. We reserve the right to charge 0.5% per day on the Net sum of the total invoice thereafter the invoice is due, until it has been paid for in full

Trade Terms in all case are 28 days, meaning 28 days from the date of issue of the invoice set out as stated above, 28 day’s free credit. Thereafter 28 days unless agreed in writing “only” (letter, email etc) to extend these terms by mutual agreement. Thereafter in accordance with the law we would be entitled to charge interest per day at the Bank of England’s base rate + 0.5% plus any reasonable costs for the recovery of the total sum of the original invoice, interest. In all events it is in the customer or business to inform Simply Wood (East) Ltd of any reason for non payment within these terms, and for arrangements to be made for mutual benefit as and when payment can be made, in writing only.   

“Where payments are asked for by return” In some cases there will be no credit given to business to business or customer on some products that Simply Wood (East) Ltd supplies. The customer or business will be made aware payment will be due on issue of an invoice agreeing to the purchase. When a purchase is made in this way the product becomes the customer or business's property thereafter and therefore the subject of seller’s terms and conditions, subject to the good’s being presented by Simply Wood (East) Ltd in good, satisfactory condition in all cases and fit for purpose in all cases. If for any reason the order is cancelled by customer or business after the order has been placed it maybe subject to the sellers return T&C’s and maybe subject to additional cost’s that are outside Simply Wood (East) Ltd control

We reserve the right to charge interest at the rate of 0.5% per working day for late payments, 7 working day's over the 28 days as specified in our payments terms   

3;Cancellation & Amendments

After the estimate has been agreed to, by confirmation in writing only, usually by email it will be deemed by the customer/business that thereafter the order has been processed and therefore cannot be cancelled as all our products are "made to order". Any order that has to be amended through structure, fixtures and fitting done by others after the final measurements have been taken and the kitchen has been made, is not therefore the responsibility of Simply Wood and therefore chargeable in all cases.

Cancellation of, return of Appliances and Third Party Products

Can be returned but maybe subject to a "re-stocking fee" issued by our stockist after 14 days, to be returned in their original packaging, unopened and fit for resale, appliance and packaging. This statement is not applicable to damaged items, on receipt of, please let us know by return so that we may have the items inspected and replaced as soon as possible. 

All items listed as storage, drawers and made to measure items are non-refundable, it is in your best interest to contact us, and we'll do our best to make sure what you have ordered is applicable, advice is always free, and we are glad to help

 4;After Purchasing a Kitchen from Simply Wood

We, Simply Wood (East) Ltd, undertake to guarantee for the period of 20 years from the date of purchase on the carcass only. Doors, drawers, doors and Frames manufactured by Simply Wood 1 + (5 years subject to terms and conditions from 01/01/ 2020). Warranty of third party products (products not manufactured by Simply Wood) doors, panels, plinths, cornice, light pelmets are subject to a 1 year warranty in all cases but would be subject to an additional manufacturer's warranty of 3,4 or 5 years subject to that of the third party manufacturer (from 01/01/20) from the date of purchase only in all cases (all 3rd party products, door's panels, components etc are subject to a total of 4 years prior to the 01/01/2020 on a sliding scale even after the warranty has lapsed to show good faith) the guarantee does not apply to worktops but in all cases we would hope to achieve customer satisfaction  during which we will replace, or repair, at our discretion, any unit that is defective as a result of faulty design, materials or workmanship (of manufacture not installation). Please note that the Guarantee does not cover defects arising from reasonable wear and tear of the unit and you will be expected to take reasonable care of the product (see below for further information on care of product). The benefit of the guarantee will only be available for the guarantee period to the original purchaser of the furniture. The guarantee is only valid in the U.K and is based on FULL payment of all goods. The guarantee does not include admin fees or installation fees, "applicable after 1 year of £180.00 in all cases". Depending on the claim involved, the age of the product's being claimed for, the reason for the claim, over 1 year, this is to cover all costs to all parties on all products, and delivery costs should there be any. Additional labour costs, will be applicable in some cases, depending on the nature of the claim and the age of the kitchen, this would be negotiated prior to any work (warranty claims/work after 1 year) being carried out. If a product is replaced by the manufacturer under warranty, the warranty of that product expires with the original warranty. The product shall be subject to normal domestic use only, this Guarantee is given in addition to and at the discretion of Simply Wood East Ltd and does not affect your statutory rights


5;Solid wood doors & painted wood doors

Timber doors: Wood is a natural product and the different grains and textures in the wood often means there are a variety of tonal differences in the doors and drawer fronts. Prior to fitting, lay out the door and drawer fronts and adjust the positions to get the best overall balance. As with a painted kitchen we will ensure of a "good match" to a selected colour but the colour may vary slightly depending on the wood chosen but in all cases care will be taken to reproduce the colour to a sample or swatch and wherever possible we would ask for it to be approved before finishing. Exposure to daylight will change the appearance of the natural wood and facias. Each type of timber reacts differently and at a different rate, becoming darker, richer and with more contrast. Exposure to direct sunlight will bleach wooden furniture. Bleaching of colours can affect your furniture within two months and will be different on each of the door and drawer front component depending upon its position relative to the windows Installation in recently plastered properties can see the moisture drawn into the timber causing a slight swelling, which will reduce when the relative humidity returns to normal. As timber is a natural product crack's may appear, from the onset, this is the timber's natural reaction to change. This is can be more noticeable with a sprayed flat finish, rather than a grained finish and hardly noticeable if at all, if it is hand painted. Colour also makes a difference. In most cases they will just need filling with a fine filler, caulk, when its dry touching in with the touch up we leave with you and that will be permanent. We will not be responsible for doing this for you after the product is installed after the initial care period, if however, the crack, split effects the integrity of the door, panel, drawer front please contact us so that we can repair it or replace it. The degree of reaction is dependent on the timber type. Solid timber doors can also be affected by heat and water and will wear accordingly. We are not responsible for the paint itself, MSDS information on request on the products we use.

We will honour our guarantee for all solid wooden door's & frames that have been made by Simply Wood East Ltd for 25 years, 3rd party Timber doors have an 1 + 5 year manufacture's warranty, subject to T&C's stated in paragraph 5.

 

6;Vinyl doors: Vinyl wrapped:

MDF doors will be affected by heat and water. Care should be taken to ensure the edges of doors are not exposed to prolonged or repeated heat from appliances, dishwasher, ovens, microwaves, etc, with kettle's and toaster's the heat will rise to the underside of wall units and can cause delamination. Integrated extractor doors are opened with the extractor in operation when a hob is in use. Care should be taken to ensure the edges of doors are not doused in water. Exposure to direct sunlight will eventually bleach the colours slightly and will be different on each of the door and drawer front component depending upon their position relative to the windows. Care should be taken when washing floors that excessive water is not applied to prevent the Plinth from over exposure to water which may cause them to swell eventually. The doors have an additional 1 + 3 year manufactures warranty from the date of purchase before 01/01/20 and a total of 1 + 5 years thereafter, see above for details, subject to T&C's, see Notes

7;Worktops/Laminate/Mistral/Solid Surface

If Fitted by Simply Wood, all defects must be reported within 1 month after installation. If fitted by a third party 2 weeks. All our worktops are installed with great care, and we check for defects as they are installed to limit any issues.

With Laminate surfaces, using board's for cutting to ensures the worktop's longevity, it may fade in places over time through sunlight and is subject to staining and swelling if there is any water intrusion around the joints or any cut outs. We do use the manufactures preferred mastics and glues etc to ensure this doesn't happen, if you see any cause for concern, please let us know as soon as you can 

With any Solid Surfaces, as hard and durable as they are, granite, quartz, man-made solid surfaces they all have limitations and are subject to cracking if under intense heat for any periods of time as well as being stood on. With heat from an appliance such as a slow cooker, grill ensure it is on a solid cutting board, so the heat is absorbed through the board. The heat will cause the material to expand very quickly in some cases and maybe crack, a sign of this if it has happened, you'll see a faint line often at an angle, not on across the joint. With solid surface's we always ensure the surface is supported to help ensure that if it's stood on, on the odd occasion that they can support the additional weight, but please tread lightly as and when you need to and DO NOT stand around the sink or hob area on any other place where the worktop has a cut out. Staining can be a problem initially but once the relevant cleaners and polishes have been used a few times this builds up a barrier and it becomes more resistant to stains and scratches. In nearly all cases, these issues will not occur, and we have only noted these types of issues periodically over our 30 years of installing all manner of worktops 

Rest assured if you do encounter any problems with your worktop, through no fault of your own or accidently we will do all we can to put it right for you. 


8;IMPORTANT NOTE
, any 3rd party product, i.e any item that is not actually manufactured by Simply Wood but it supplied by Simply Wood as part of their product is subject to the 3rd party manufacturer's warranty only, if the product is deemed defective and replaced under that manufacturer's warranty it will be supplied under those T&C's but will not include the replacement fitting of the item, cost of delivery or administration fees of 3rd party or Simply Wood East Ltd, whether it is a door, drawer or any component(s), unless it is within 1 year of installation, thereafter this will be chargeable


9;NOTE
The above warranties are only applicable for domestic application after 1 year, commercial, new builds, trade & rental warranties are 1 year, this does not affect your statutory rights, should there be a problem of any kind we will do all we can to help you resolve any issues and, in most cases, extended warranties will be implemented at the discretion of Simply Wood East Ltd only.  Rest assured we will always do what we can to ensure, to repair, replace your affected product. With care your kitchen should give you good service and last 10 years and hopefully many more, we use the best quality materials to ensure this at Simply Wood
